Standards and legislation on digital accessibility

Current legislation has turned accessibility from an ethical choice into an operational requirement that is monitored and can be penalised.

From WCAG 2.2 to the European Accessibility Act

The international technical reference point is the W3C’s WCAG (Web Content Accessibility Guidelines). The Web Content Accessibility Guidelines (WCAG) 2.2 rest on four core principles, summed up in the acronym POUR: perceivable, operable, understandable and robust.

The guidelines are structured into different levels of conformance and offer verifiable methods for guaranteeing universal access to sites and applications. By following these standards, developers can break down complex digital barriers, making navigation more inclusive for every type of user.

In legislative terms, the European Accessibility Act, transposed in Italy in 2022, extends accessibility obligations to private bodies providing essential digital services (banks and transport operators, for example), with full effect from 28 June 2025.

Web accessibility for the public administration

Public administrations are subject to the strictest and most immediate obligations:

  • Technical requirements: sites and apps compliant with WCAG 2.1 AA, with an indication that they should progressively move towards version 2.2 AA.
  • Documentation obligations: publication of the Accessibility Statement by 23 September each year and of their Accessibility Objectives by 31 March.
  • Organisation: appointment of an ICT Accessibility Officer, a role that often coincides with that of the Digital Transition Officer (RTD).

Web accessibility for public economic bodies and publicly controlled companies

  • Legislative reference: the AgID Guidelines impose a full obligation of conformity.
  • Requirements: they are subject to the same obligations to publish an Accessibility Statement and to comply with the WCAG technical standards.

Accessibility for private companies providing essential public services

This category includes banks, transport, energy services and private healthcare operating under public agreements.

  • Legislative reference: they are subject to the European Accessibility Act (EU Directive 2019/882), transposed in Italy by Legislative Decree 82/2022.
  • Timeline: the obligation came fully into force on 28 June 2025. From that date, digital services offered to the public must meet the accessibility requirements.

Accessibility obligations for e-commerce

From 28 June 2025, e-commerce services aimed at consumers also fall within the obligations set out in Legislative Decree 82/2022, which transposes the European Accessibility Act. Micro-enterprises are exempt, that is businesses with fewer than 10 employees and an annual turnover or balance sheet total of no more than 2 million euros.

Accessibility has to cover the whole purchasing experience, including navigation, product pages, checkout and payment, in line with the requirements laid down for digital services.

Does digital accessibility apply to private companies too?

Private companies with an average turnover above 500 million euros over the past three years are currently subject to specific obligations deriving from the extension of Law 4/2004.

  • Current obligation: they must submit and publish an Accessibility Statement on their websites.
  • Transition: where such bodies are already economic operators providing services subject to Legislative Decree 82/2022 (the EAA), they will follow the provisions of that decree rather than Law 4/2004.
